TERMS & CONDITIONS.

Welcome to the Beluga website (the “Site”). These Terms & Conditions (“Terms”) set out the rules for using our Site and, where relevant, buying from or working with Beluga Consulting Ltd (“Beluga”, “we”, “us”, “our”).

By accessing or using our Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Beluga Consulting Ltd is a Learning & Development consultancy. We design and deliver learning, leadership, culture, employee experience and engagement solutions, including consultancy, workshops, programmes, experiences, and related materials.

2. Using Our Website

You agree to use the Site lawfully and in a way that does not:

  • Infringe the rights of others

  • Interfere with others’ use of the Site

  • Introduce viruses, trojans, worms, or other harmful code

  • Attempt unauthorised access to the Site, our servers, or connected systems

 

We may suspend or restrict access to the Site if we reasonably believe there has been misuse or a breach of these Terms.

3. Information on the Site

We do our best to keep the Site accurate and up to date. However:

  • Content is provided for general information only

  • It is not professional advice, and you should not rely on it as such

  • We may update, change, remove, or correct content at any time without notice

4. Our Services

Any service descriptions on the Site are indicative and may be tailored depending on your needs, scope, timeline, and availability.

Where you purchase services from us, the specific terms will be set out in a proposal, statement of work, booking confirmation, licence terms, or other written agreement (“Service Agreement”). If there is any conflict between these Terms and a Service Agreement, the Service Agreement will take precedence.

5. Bookings, Fees, and VAT

Unless otherwise stated:

  • All prices are in GBP and exclude VAT

  • VAT will be added where applicable

  • Invoices are payable on the terms stated on the invoice or Service Agreement

 

We may require deposits or staged payments for certain services or bookings.

6. Cancellations, Rescheduling, and Refunds

Because most of our work is designed and planned around real people, real diaries, and real delivery time, cancellations and changes have an impact.

 

Unless your Service Agreement states otherwise:

  • Refunds are not guaranteed and are considered case by case

  • We may retain fees already paid to cover work completed, preparation time, and committed delivery time

  • Rescheduling requests will be considered in good faith, subject to facilitator availability and reasonable notice

 

If we are unable to deliver a service due to circumstances within our control, we will work with you to reschedule or agree an appropriate remedy, which may include a refund for undelivered elements.

7. Digital Products, Toolkits, and Licensed Materials (if applicable)

Where we provide downloadable materials, toolkits, session kits, slide decks, or similar (“Materials”), they are provided under a licence for your internal use only, unless we agree otherwise in writing.

 

You must not:

  • Share, resell, distribute, publish, or make the Materials available to third parties

  • Copy or adapt the Materials for use by another organisation

  • Remove our copyright notices or branding elements we reasonably require

 

If your organisation needs a broader licence (multi-entity, global, or repeated delivery), this must be agreed in writing.

8. Intellectual Property

Unless stated otherwise, all content on this Site (including text, designs, graphics, videos, frameworks, training concepts, and downloadable resources) is owned by or licensed to Beluga and is protected by intellectual property laws.

 

You may:

  • View and print pages for personal, non-commercial use

 

You may not:

  • Reproduce, copy, modify, distribute, or commercially exploit any content without our written permission

 

Beluga names, brand elements, and trademarks must not be used without permission.

9. Testimonials, Case Studies, and Results

Any testimonials or examples on the Site reflect individual experiences. They do not guarantee specific outcomes.

Learning and development outcomes depend on many factors, including participant engagement, organisational context, follow-through, and implementation. For that reason, we do not guarantee particular results unless expressly agreed in a Service Agreement.

10. Photography, Video, and Image Use

We use a mix of photography across our Site and materials. This may include:

  • Images created by Beluga or our partners

  • Licensed stock imagery

  • Photographs from delivery (where we have appropriate permissions)

  • Illustrative or staged images used for brand and storytelling purposes

 

You must not download, reuse, edit, or republish images from our Site without our written permission.

If you provide us with images, logos, or brand assets, you confirm you have the rights to share them with us for the purpose of delivering the work.

If we capture photography or video during delivery, usage and permissions will be agreed with you in advance (including any consent required from participants).

11. External Links

Our Site may contain links to third-party websites. We do not control or endorse those sites and are not responsible for their content, availability, or practices. Accessing third-party links is at your own risk.

12. Limitation of Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

 

Subject to that, to the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential losses (including loss of profit, revenue, business, goodwill, or data)

  • We are not liable for losses arising from your use of (or inability to use) the Site

  • Our total liability in connection with any claim relating to the Site or services will not exceed the amount paid by you to us for the specific services giving rise to the claim

13. Accounts and Access (if applicable)

If you create an account (or access protected resources), you are responsible for keeping your login details confidential. You must notify us promptly if you believe your account has been compromised.

We may suspend or terminate accounts or access where we reasonably believe there has been misuse or breach of these Terms.

14. Privacy and Cookies
